Social Networking websites and mobile technology have created new ways to communicate and connect with family, friends and businesses as well, however one Texas company allegedly went too far when attempting to collect payment for home improvement services. The complaint alleges defendants Homeland Septic, LLC and owners Justin Smock and Lawrence Brumbelow violated the Texas Fair Debt Collection Practices Act and the Texas Deceptive Trade Practices Act, Texas Business Commerce Code.
According to court documents, Plaintiff Lynn Kirkpatrick contracted with Homeland Septic to perform work in his back yard on the septic system and allegedly did not accept or approve the work and disputed the final bill. Homeland Septic allegedly claimed the work was complete and payment for the services was due and despite Mr. Kirkpatrick’s disputes, the defendants allegedly continued to hound Mr. Kirkpatrick for payment.
Collection efforts allegedly included voice mails and text messages containing abusive, vulgar language and threats regarding Mr. Kirkpatrick’s family and home. According to court documents, defendant Smock allegedly sent a communication to Kirkpatrick using social media site Facebook’s messaging system, claiming he had placed a lien on Plaintiff’s house for an amount that was 3 times the amount of the money owed when in fact court records showed no lien had been officially filed and placed on Mr. Kirkpatrick’s home.
According to recent news articles, the collection methodology used by debt collectors has changed due to the popularity of social networking sites such as Facebook, Twitter and LinkedIn and the easy access to user’s personal information these sites provide. McGeough and Lamacchia hope their involvement in these discussions will ensure no changes are made to the Mortgage Interest Deduction.
“We applaud the NAR government affairs team and the RPAC for their relentless work fighting for homeowners and Realtors in these important causes,” says John McGeough.
Some of the major mortgage lenders had large booths set up at the convention including Bank of America, JP Morgan Chase, PNC and Wells Fargo. Their primary focus was building their home mortgage relationships with real estate agents, but Bank of America also set up a team of short sale escalation negotiators on site to assist Realtors with any short sales they may be having trouble with.
“Just like at last year’s convention, I was once again especially impressed with Bank of America for trying to help Realtors,” says Lamacchia. “It also gave us a chance to meet some of the people who have assisted us with our short sales over the years. Bank of America has had their troubles since their takeover of Countrywide Home loans but they certainly put in a lot of effort to right the ship.”
The Greater Boston Association of Realtors and the Massachusetts Association of Realtors both held receptions on separate nights at the convention.
“It was nice to be able to spend some time talking with many of our fellow Realtors who we do business with,” says Lamacchia.
The National Association of Realtors Annual Conference held more than 100 education sessions, featuring nationally-recognized speakers, trainers, and industry experts, to discuss critical issues of value to Realtors. Over 18,000 Realtors from across the country and some from around the world attended.
“It was a productive 3 days; we always seem to gain insight when we travel to these events. We have been getting more and more involved with NAR’s government affairs committee and it is proving to be worth it as they are a great group of people,” says McGeough.

“It’s impossible to hear the stories behind these projects and not want to do something to help,” said Steve Barron, president of Barron Designs.
Dale Dunning started “Jusst Sooup” while in college. Now she gets up every day at 2 a.m., with her husband Ken and son Brooks, to cook for four Delaware soup kitchens, providing comfort to those in need.
When “EMHE” found out that the Dunnings were accomplishing all of this while living in what is essentially a converted “Jusst Sooup” storage facility, Ty Pennington and his team knew they had to help.
The Dunning family dream is to not just have a home for themselves, but a facility where they can cook on a large scale so they can feed more Delaware families. They also hoped for a space large enough to put micro-homes on the property to help people get on their feet and have a garden that can grow supplies for the soup kitchen.
The designers at “EMHE” decided that an old-fashioned farmhouse look would be perfect for the main building. Knowing the quality and realistic texture they get from Faux Wood Beams, the producers turned to Barron Designs yet again to create a king truss to unify the great room in the main house, creating an open, airy, yet cozy feeling for the Dunning’s new home.
“An old-fashioned ceiling was the perfect way to create a classic farmhouse,” said Steve Barron.
While most designers use faux wood beams as they are – the polyurethane beams are made from molds of genuine timber – “EMHE’s” designers wanted to create the look and feel of old farmhouse beams to match the Dunning’s dream of having a farm on the property to grow soup ingredients. Knots were painted to appear more pronounced and the beams were given the grayish patina of aged wood. Because the Dunnings spend so much of their time helping others, the low maintenance faux beams were a perfect choice.
“The faux finishers did an outstanding job,” said Steve Barron. “The trim carpenters from BZ Construction Services were fantastic. The people you meet on these builds are amazing. You don’t hear enough about that. The volunteers are incredible.”
“’Extreme Makeover’ could do another entire show on the volunteers and everything that happens behind the scenes,” said Barron. “It’s a real community that accomplishes so much in so little time.”
This build was even more challenging than most because it was interrupted by Hurricane Irene. For the first time ever, an “Extreme Makeover: Home Edition” project had to pause to evacuate for safety and then resume.
The Dunning family/”Jusst Sooup” project is one of many collaborations between Barron Designs and “Extreme Makeover: Home Edition” and it’s far from the last.
“Why do we do this — it feels good to give back. We’re a family business so doing something special for a family like the Dunnings – I can’t begin to describe how good it feels,” said Steve Barron.
